Frequently Asked Questions About DUI

6. What are the penalties for a DUI conviction?

DUI first offense:

Fine not less than $250 nor more than $1,000.
Imprisoned for not more than 48 hours.
Ordered to attend the Mississippi Alcohol Safety Education Program (MASEP).
Driver's license suspension not less than 90 days nor more than one year.

A hardship may be available for a first offense DUI where the person convicted took the breath test. Hardship is not available where the person refused to take the intoxilyzer test.

DUI second offense (within five years of previous conviction):

Fine not less than $600 nor more than $1,500.
Imprisoned not less than 10 days nor more than a year.
Community service not less than 10 days nor more than one year.
Driver's license suspension for two years.

The license suspension may be reduced to one year if the person receives an in-depth diagnostic assessment, and as a result of such assessment is determined to be in need of treatment of his alcohol and/or drug abuse problem and successfully completes treatment of said problem at a program site certified by the Department of Mental Health.
