G.S. 58-63-15 (11) defines unfair claim settlement practices as:

 • failing to acknowledge and act reasonably promptly upon claims arising under insurance policies,

 • failing to adopt and implement reasonable standards for the prompt investigation of claims,

 • refusing to pay claims without conducting a reasonable investigation,

 • failing to affirm or deny coverage of claims within a reasonable time,

 • not attempting in good faith to effectuate prompt, fair and equitable settlements of claims in which liability has become reasonably clear,

 • compelling the insured to institute litigation to recover amounts due under an insurance policy by offering substantially less than the amount to which a reasonable man would have believed he was entitled.

1. ALWAYS call police.
2. Always get identification of other vehicle (tag number, make, and model) and driver (address and phone numbers).
3. Make a written list of all witnesses and their phone numbers.
4. Never deny that you are injured unless your are absolutely certain.
5. If injured, take an ambulance to the emergency room and see a doctor immediately.
6. Get documentation of your injury from your doctor.
7. Don't give a statement to anyone without consulting your own lawyer: anything you say could be used against you to help defeat your claim!
