DRIVING WHILE IMPAIRED (DWI)

     North Carolina has some of the toughest drinking-and-driving laws in the United States.  To be found guilty of the offense of DWI you only need to drive on the streets or highways after "consuming a sufficient quantity of some impairing substance (like alcohol) so as to appreciably impair your mental and/or physical faculties" - or have a blood alcohol level of .08 or higher at "any relevant time after driving."

Personal Injury

     The term "personal injury" covers a lot of ground.  Physical and/or mental injuries caused by car accidents, medical or professional malpractice, dog bites, sexual harassment, harmful products, and slip and falls are all types of personal injuries, and there are many more.

     All personal injury cases must stand on three "legs" in order to be successful.  The three "legs" are liability, damages, and a source of recovery.

     Liability means that some entity, individual or company (legally known as the "tortfeasor") is held responsible for the damages incurred by an injured party.

     For example, you have a legal duty to stop at a stop sign, and if you fail in your duty and injure someone else as a result, you may be held liable, or legally responsible, for the damages that you cause.  The liability issue is full of twists and turns, however.  For instance, if, in the example above, your brakes failed through no fault of your own and you ran the stop sign, you may escape liability.

     There are two basic types of damages, I call them "hard" and "soft" damages.  "Hard" damages can be quantified - lost wages, hospital bills, property damage, future medical expenses, etc.  "Soft" damages cannot be quantified.  Pain and suffering, scars and disfigurement, emotional distress, loss of the use of part of the body - these are damages that don't readily convert to dollars and cents, but have a dollar value nonetheless.

     A source of recovery means, simply, where the money comes from to pay for the damages incurred.  Insurance laws are complex and finding all the coverage available takes time, tenacity, and experience.
