There are, generally, two types of bankruptcy that an individual can file under. One is a Chapter 7, the other is a Chapter 13. In a Chapter 13 case, the debtor (the person who files bankruptcy) makes payments to a Trustee, who then makes payments to the creditors. A Chapter 7 is known as a "total liquidation". It is used by individuals who have primarily consumer, unsecured debts like credit cards and personal loans and, for whatever reason, find themselves unable to pay them. A Chapter 7 is like a nuclear weapon. It annihilates unsecured debt, and gives the person filing bankruptcy a "fresh start”.
